The Firm’s commercial and real estate practice is broad-based and includes representing and counseling with clients on virtually every aspect and phase of commercial and real estate matters. The Firm’s representative client list in this area includes many prominent borrowers and lenders with both local and national operations, including developers, banks, life insurance companies, tenants, mortgage brokers, homebuilders, and realtors.

Rushton, Stakely, Johnston & Garrett attorneys have extensive experience in representing and advising clients in a variety of real estate matters including malls, strip shopping centers, apartments, and office buildings. The Firm regularly prepares and negotiates partnership and joint venture agreements, acquisition and sales contracts, construction, operation, and easement agreements, major tenant leases, architect’s and construction contracts, and loan documents. In representing lenders, the Firm has assisted and advised clients with respect to loan commitments, loan document preparation, and negotiation of pertinent documents. Firm lawyers advise creditors and borrowers with respect to creditors’ rights and bankruptcy. The Firm also advises both creditors and debtors with respect to matters arising out of loan defaults, including creditors’ rights and bankruptcy proceedings.

Rushton, Stakely, Johnston & Garrett frequently serves as “local” counsel to purchasers, sellers, their lenders, and law firms on transactions involving property located in multi-state transactions. The fact that the Firm’s office is located in the State’s capital and in the geographic center of Alabama has proved convenient and beneficial in these transactions.

Several attorneys at the Firm are also actively engaged in representing lenders, equity providers and developers in the affordable housing industry. This representation includes counseling clients with respect to investing in housing tax credit projects, compliance with housing tax credit requirements, and securing housing tax credits as well as other affordable housing programs.

Title examination and conveyancing are a standard part of Rushton, Stakely, Johnston & Garrett’s real estate practice. The Firm is an agent for several prominent national title insurance companies.
