11/22/2006 - Pulmonologist defeats medical malpractice/wrongful death claim

DOTHAN--A Dothan physician specializing in pulmonary medicine recently received a directed verdict in a medical malpractice case.  The allegations centered on the prescription of several medications to a patient who had been diagnosed with congestive obstructive pulmonary disease (COPD).  The plaintiff alleged that the medications administered were actually those of a different patient and that prescribing them to the plaintiff constituted a violation of the standard of care.  After a five-day trial, Circuit Judge Denny Holloway entered a directed verdict in favor of the pulmonologist and dismissed the case.  A co-defendant hospital also received a directed verdict.  The defense of this case was handled by Fred W. Tyson and Ben C. Wilson of RSJG.
