11/15/2006 - Attorney Cleared of Malpractice
MONTGOMERY--Plaintiff, Carlos Williams alleged that his former attorney, Benjamin E. Pool failed to render professional legal services while representing him in a criminal case because he did not determine that Williams' probation for a prior conviction had been terminated prior to his arrest for possession of drugs. Williams asserted that because the court incorrectly interpreted his probation status at the time of his arrest, he was denied bail and caused to serve six months in jail. Ben Pool was represented by Robert C. Ward, Jr. of Rushton, Stakely, Johnston & Garrett. Jefferson County Circuit Judge James Hard (appointed to hear the matter after Montgomery County judges recused themselves) ruled that the lawsuit was without merit after having considered the defendant's motion to dismiss and the oral argument made by attorney Ward.
