2/16/2006 - Jury Rules for Nursing Home in Dothan
After several days of trial before Judge Larry K. Anderson, a Houston County jury issued a defense verdict for Flowers Hosptial d/b/a Westside Terrace Nursing Home and QHG of Alabama, Inc. Defense attorneys were William S. Haynes of Rushton, Stakely, Johnston & Garrett, P.A. and Alan C. Livingston with Lee & McInish, P.C. of Dothan. Plaintiff's attorneys were W. Todd Harvey with Whatley-Drake, LCC, Birmingham, Albama, and Gregory B. McCain of Dothan, Alabama.
Plaintiff claimed that the nurses at Westside Terrace committed nursing malpractice by negligently allowing a resident, Irelle Moore, to fall out of a wheelchair and suffer a subdural hematoma. Plaintiff also claimed that the nurses' substandard care adversely affected Mrs. Moore's quality of life. Defendant denied that it was guilty of negligence and that nursing negligence, if any, did not cause Irelle Moore's diminished quality of life.
