3/18/2008 - Arbitrator Cuts Claim of Contractor by $128,000
MALBIS--The American Arbitration Association today issued an award of $442,000 to a site contractor relating to paving work done on the Eastern Shore Centre. The contractor claimed $570,000 for unpaid paving and ADEM expenses. The amount awarded was less than the retainage. After a two-day arbitration in Malbis, the arbitrator, John Hill Allgood, III, issed a reasoned award to the site contractor cutting its claim 15% on the paving and disallowing the ADEM claim in total. The arbitrator awarded no attorney's fees to either side. Rushton, Stakely, Johnston & Garrett, P.A. attorneys Dennis R. Bailey and Bethany L. Bolger represented the owner. Robert A.
