5/25/2007 - Lamberts Successfully Defend TCC Claims of Breach of Non-Compete

MONTGOMERY--Magistrate Judge Charles Coody granted summary judgment for Harry E. Lambert and his wife's trucking company--Carol's Contracting, Inc.--as to claims filed by The Concrete Company alleging that Lambert and his wife's company conspired with Alabama Gravel LLC and others to violate a non-compete provision contained in a buy-sell agreement.  Subsequent to the entry of the order, TCC agreed to pay $175,000 to the Lambert's for a release and stipulation of dismissal of all claims.  The case was dismissed with prejudice July 5, 2007.  The Lamberts were represented by Dennis R. Bailey and Bethany L. Bolger of Rushton, Stakely, Johnston & Garrett, P.A.  The Concrete Company was represented by William L. Tucker and Thomas F. Gristina of Page, Scrantom, Sprouse, Tucker & Ford P.C. as well as Robin G. Laurie and G. Lane Knight of Balch & Bingham.  The case was styled The Concrete Company v. Harry E. Lambert, et. al, 2:05cv1026-CSC.  Judge Coody's memorandum opinion is attached.
